These Terms of Service ("Terms") govern your access to and use of the Ksara platform at ksara.ai (the "Service"), operated by Kabavo LLC ("Ksara", "we", "us", or "our"), a company registered in the Republic of Belarus (TIN/UNP 193832940).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- "User" — any individual who creates an account on Ksara
- "Workspace" — an organizational unit within Ksara, owned by a User, to which other Users may be invited
- "Workspace Owner" — the User who created the Workspace and holds full administrative rights
- "Connected Account" — a third-party advertising or social media account linked to Ksara via OAuth
- "Content" — any data, metrics, files, or information uploaded to or synced through the Service
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration
3.1 Account Creation
To use Ksara, you must create an account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your credentials.
3.2 Account Security
You agree to:
- Keep your login credentials secure and not share them with third parties
- Notify us immediately at k@kbv.by if you suspect unauthorized access
- Accept responsibility for all activity that occurs under your account
3.3 One Person, One Account
Each individual should maintain only one account. Automated account creation is prohibited.
4. Use of the Service
4.1 Permitted Use
Ksara is a performance analytics platform designed for businesses and marketing professionals. You may use the Service to:
- Connect and monitor advertising accounts across supported platforms
- View, analyze, and export performance metrics and reports
- Manage team access through workspace roles
- Upload and manage ad statistics data
- Calculate and manage contractor payroll
4.2 Prohibited Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble any aspect of the Service
- Use automated bots, scrapers, or scripts to access the Service (except through our official API)
- Interfere with or disrupt the integrity or performance of the Service
- Upload malicious files, viruses, or harmful code
- Resell, sublicense, or redistribute the Service without written permission
- Use the Service to collect data about other users without their consent
- Circumvent rate limits, access controls, or other security measures
5. Workspaces and Team Access
5.1 Workspace Ownership
The User who creates a Workspace is the Workspace Owner. Ownership may be transferred to another member by contacting support.
5.2 Roles and Permissions
Ksara supports the following workspace roles, each with different permissions:
- Owner: Full access, including billing, team management, and deletion
- Admin: Most management capabilities except ownership transfer and workspace deletion
- Manager: Can view and manage campaigns, connectors, and reports
- Viewer: Read-only access to dashboards and reports
5.3 Responsibility
Workspace Owners are responsible for the actions of all members they invite. Ensure that only authorized individuals have access to your workspace.
6. Connected Accounts and Third-Party Platforms
6.1 OAuth Authorization
When you connect an advertising or social media account, you grant Ksara read access to performance metrics through the platform's official API via OAuth 2.0. We request only the minimum permissions necessary.
6.2 Token Security
OAuth tokens are encrypted using AES-256-GCM and stored securely. Tokens are never exposed to the browser or logged in plaintext. You may revoke access at any time by disconnecting the account in Ksara or revoking access from the platform's settings.
6.3 Third-Party Terms
Your use of connected platforms is subject to their respective terms of service and privacy policies. Ksara is not responsible for changes to third-party APIs, rate limits, or data availability.
7. Data Ownership and Intellectual Property
7.1 Your Data
You retain full ownership of all data you upload to or sync through Ksara. We do not claim any intellectual property rights over your Content.
7.2 License to Ksara
By using the Service, you grant us a limited, non-exclusive, worldwide license to process, store, and display your Content solely for the purpose of operating and improving the Service.
7.3 Ksara IP
The Service, including its design, code, algorithms, branding, and documentation, is the intellectual property of Kabavo LLC. You may not copy, modify, or create derivative works of the Service.
8. Payments and Billing
8.1 Pricing
Current pricing is displayed on the Ksara website and within the Service. Prices may change with 30 days' prior notice.
8.2 Billing Cycle
Subscriptions are billed monthly or annually, depending on your chosen plan. Payment is due at the start of each billing period.
8.3 Refunds
We offer a 14-day money-back guarantee for new subscriptions. After this period, payments are non-refundable. To request a refund, contact k@kbv.by.
8.4 Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. Your data will be retained for 30 days after the subscription expires, after which it will be permanently deleted.
9. Service Availability
9.1 Uptime
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
9.2 Maintenance
Scheduled maintenance will be announced at least 24 hours in advance. Emergency maintenance may be performed without prior notice.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied
- We do not warrant that the Service will be error-free, secure, or uninterrupted
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim
- We are not responsible for decisions you make based on data displayed in Ksara
11. Indemnification
You agree to indemnify and hold harmless Kabavo LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Your violation of any third-party rights
- Content you upload or sync through the Service
12. Termination
12.1 By You
You may terminate your account at any time by contacting k@kbv.by or through the account settings.
12.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- Your use poses a security risk to the Service or other users
- Your account has been inactive for more than 12 months
- Required by law
We will provide 14 days' notice before termination, except in cases of serious violations or legal requirements.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Belarus.
13.2 Jurisdiction
Any disputes arising from these Terms shall be submitted to the competent courts of the city of Minsk, Republic of Belarus.
13.3 Amicable Resolution
Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably through negotiation within 30 days of written notice.
14. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 14 days before taking effect. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
15. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Kabavo LLC
- Severability: If any provision is found to be unenforceable, the remaining provisions shall remain in effect
- No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights freely
